By accessing and using artify.gg ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Artify.gg provides AI-powered image generation services including:

• Logo Generation
• Image Generation
• Background Removal
• Emoji Generation
• Custom AI Model Training
• Image Enhancement Tools

3. User Accounts

3.1 Registration

• You must be at least 18 years old to purchase a subscription
• Users between 13-17 require parent/guardian consent
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One person may only create one account

3.2 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay for services

4. Subscription and Payments

4.1 Pricing Tiers

We offer multiple subscription tiers:

• Free: 40 credits
• Basic: 800 credits ($9/month)
• Pro: 2000 credits ($20/month)

4.2 Payment Terms

• All payments are processed securely through Paddle.com
• Subscriptions are billed automatically in advance on a monthly basis
• You authorize us to charge your chosen payment method through Paddle
• Prices are subject to change with 30 days advance notice
• All prices are in USD unless otherwise stated
• Credits expire at the end of each billing cycle

4.3 Subscription Cancellation

• You may cancel your subscription at any time through your account dashboard
• Cancellation will take effect at the end of your current billing period
• No partial refunds for unused subscription time
• Access to premium features continues until the end of paid period
• Credits are forfeited upon cancellation

4.4 Refund Policy

• 14-day money-back guarantee on all new paid subscriptions
• Refund requests must be submitted to [email protected]
• Refunds are processed through your original payment method via Paddle
• Refunds may be denied for:
  • Excessive usage (over 50% of credits used)
  • Violation of terms of service
  • Fraudulent activity
  • Repeated refund requests

4.5 Failed Payments

• Failed payments will result in automatic retry attempts
• Access may be limited after failed payment attempts
• You are responsible for updating payment information
• Account suspension may occur after prolonged payment failure

5. Acceptable Use

5.1 You Agree Not To:

• Generate illegal or harmful content
• Infringe on intellectual property rights
• Attempt to reverse engineer our systems
• Share or resell account access
• Exceed usage limits intentionally
• Use automated scripts without permission

5.2 Content Guidelines

Generated content must not:

• Promote hate speech or discrimination
• Contain explicit adult content
• Violate copyright or trademark rights
• Impersonate others maliciously

6. Intellectual Property

6.1 Service Ownership

• The Service, including all software and technology, is owned by artify.gg
• Our logo, brand, and trademarks are protected

6.2 Generated Content

• You own rights to AI-generated content you create
• We maintain right to use generated content for Service improvement
• You grant us license to store and process your content

7. Credits and Usage

7.1 Credit System

• Credits are required for generation services
• Credit costs vary by service type
• Unused credits expire at end of billing period
• Credits are non-transferable

7.2 Usage Limits

• Fair use policies apply to all accounts
• We may impose additional limits to prevent abuse
• Enterprise customers may request custom limits

8. Data and Privacy

8.1 Data Collection

• We collect data as described in our Privacy Policy
• Usage data helps improve our AI models
• We implement industry-standard security measures

8.2 Data Protection

• We use encryption for data protection
• We regularly backup user data
• We comply with applicable data protection laws

9. Liability and Warranties

• No guarantee of uninterrupted service
• We strive for 99.9% uptime but don't guarantee it

9.2 Limitation of Liability

• We're not liable for indirect damages
• Our liability is limited to fees paid
• Force majeure applies to service interruptions

10. Changes to Terms

• Continued use constitutes acceptance of changes

11. Termination

You may terminate your account by:

• Generated content remains accessible for 30 days
• No refund for unused portion of subscription
